Yes, as soon as you offer an AI system to clients in the EU or its output is used there. Even outside that case, the Swiss nFADP applies to any processing of personal data by an AI. The Federal Council also announced in 2025 a sector-based regulation and the ratification of the Council of Europe AI Convention.
Not with the consumer versions, whose terms allow training on your data. With an enterprise version and a data processing agreement, it can work for some data. For professional secrecy (lawyers, doctors, fiduciaries), we recommend a model hosted in Switzerland.
No. We choose according to data sensitivity: public model for marketing content, Swiss or local model for client data. A mix of both is often the most cost-effective.
